This information notice is provided pursuant to art. 13 of Legislative Decree 30.06.2003, 196 (“Personal Data Protection Code”) and art. 13 of EU Regulation no. 2016/679 (“General European Regulation on the Protection of Personal Data”).
The company Azienda Agraria Bacci Rolanda, with registered office at via Putuense n.45 – 06035 – Gualdo Cattaneo, VAT: 02751090545, represented by Rolanda Bacci, as Data Controller (hereinafter, "Controller"), informs you pursuant to art. 13, Legislative Decree 30.06.2003, 196 (hereinafter, "Privacy Code") and art. 13, EU Regulation no. 2016/679 (hereinafter, "GDPR") that your data will be processed in the following ways and for the following purposes:
1. Subject of the processing
The Data Controller takes care to protect your personal data and complies with the applicable personal data protection regulations (Privacy Code and GDPR 12016/679). Your personal data is treated confidentially and is transferred to third parties only as provided for in this Policy, or with your consent. We process the personal data you provide to us during the use of the website and/or after registering on the website.
In particular, we deal with:
the personal, identifying and non-sensitive data (in particular, name, surname, tax code, VAT number, email, telephone number – hereinafter, “personal data” or also “data”) directly provided by you, with the registration on the site and/or the request to use the individual socio-educational and socio-assistance services offered; strictly nominal data of minor users
data not directly provided by you – and in any case acquired within the limits set out by art. 14, paragraph 5, GDPR – whose transmission is connected to the use of Internet communication protocols (by way of example only, page accesses, amount of data transferred, status messages upon access, session ID numbers, IP addresses, URL addresses, etc.). This data makes it possible to reconstruct the path of your visits to the site.
2. Purpose of processing
Your personal data are processed:
A) without your explicit consent (art. 24, lett. a), b), c), Privacy Code and art. 6, lett. b), e), GDPR), for the following Service Purposes:
process a contract request or a pre-contractual request;
to carry out pre-contractual measures adopted at your request;
process internal statistics;
fulfill the tax obligations arising from existing relationships;
fulfill the obligations established by law, by a regulation, by community legislation or by an order of the Authority;
safeguard the vital interests of the data subject or of another natural person;
to carry out tasks of public interest or connected to the exercise of public powers vested in the data controller;
prevent or detect fraudulent activities or abuses harmful to the website;
to pursue a legitimate interest of the Data Controller or of third parties, within the limits and under the conditions set out in Article 6, letter f), GDPR;
exercise the rights of the Data Controller (by way of example only, the right of defense in court);
B) Only with your specific and unequivocal consent (Articles 23 and 130, Privacy Code and Article 7, GDPR), for the following Marketing Purposes:
send newsletters, commercial communications and/or advertising material by email regarding products and/or services, different and/or dissimilar from those already purchased, offered by the Data Controller.
3. Nature of providing personal data
The provision of your Data for the purposes described in point 2, lett. A), nos. i and ii) is necessary. Without providing it, we cannot guarantee your registration on the Site, nor the possibility of fulfilling your requests.
The provision of Data for the purposes described in point 2, letter b), is instead optional. You can therefore decide not to provide any data or to revoke our ability to process data previously provided. In this case, you will no longer receive our newsletters, while you will continue to receive our services and retain the right to register on the site.
4. Methods of processing
The processing of your personal data is carried out by means of the operations indicated in art. 4 of the Privacy Code and art. 4, no. 2), GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, erasure, and destruction of data. The processing of your data will be based on the principles of fairness, lawfulness, and transparency and may also be carried out through automated means designed to store, manage, and transmit them, and will take place using appropriate tools, as far as reasonably possible and according to the state of the art, to ensure security and confidentiality through the use of suitable procedures that prevent the risk of loss, unauthorized access, unlawful use, and dissemination.
5. Data retention period
The Data Controller will process personal data for the time necessary to fulfill the purposes mentioned above and for no longer than 2 years from the collection of the data for Marketing Purposes. After this retention period, the data will be destroyed or made anonymous.
6. Data access
The personal data processed by the Data Controller will not be disseminated, meaning they will not be made known to unspecified subjects in any possible form, including by making them available or for simple consultation. However, they may be communicated to employees working under the Data Controller and to certain external parties who collaborate with them. In particular, your data may be made accessible to:
employees and collaborators of the Data Controller, consultants authorized to manage the website and provide related services (by way of example: customer services, IT department, etc.), in their capacity as internal Managers and/or Persons in charge of processing personal data and/or System Administrators;
third-party companies or other entities (by way of example only: credit institutions, professional firms, consultants, insurance companies, etc.) that carry out outsourcing activities on behalf of the Data Controller, in their capacity as external Data Processors and/or persons in charge of processing personal data.
Your data may also be communicated, within the strictly necessary limits, to parties authorized to access it by virtue of legal provisions, regulations, or EU legislation.
7. Data disclosure
Without your explicit consent (pursuant to art. 24 letters a), b), d), Privacy Code and art. 6 letters b), c), GDPR), the Data Controller may disclose your data for the indicated purposes to supervisory bodies, judicial authorities, as well as to all other subjects to whom communication is mandatory by law for the fulfillment of said purposes.
8. Data transfer
The management and storage of personal data will take place on the Data Controller's servers and/or those of third-party companies appointed and duly designated as Data Processors, located within the European Union, or in accordance with the provisions of Articles 45 et seq., GDPR. Currently, the servers are located in the European Union. The data will not be transferred outside the European Union. In any case, it is understood that, should it become necessary to transfer the location of the servers, in Italy and/or the European Union and/or non-EU countries, such transfer will always take place in compliance with Articles 45 et seq., GDPR. In any case, the Data Controller hereby assures that the transfer of data outside the EU will take place in accordance with applicable legal provisions by entering into, if necessary, agreements that guarantee an adequate level of protection and/or by adopting the standard contractual clauses provided by the European Commission.
9. Browsing data
The IT systems and software procedures responsible for the functioning of the site may acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified (i.e. parameters related to the user's operating system and IT environment). Such data is used by the Data Controller solely for the purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning, and is deleted immediately after processing. This data may also be used to ascertain responsibility in the event of hypothetical computer crimes against the Site.
10. Cookies
When you use our site, cookies are stored on your computer. Cookies are small text files that are saved on your computer and provide us with certain information. They are widely used in order to make websites function or function more efficiently to improve the user experience, as well as to provide certain information to the site owners. Our site uses cookies that remain on your computer for different periods of time. 11. Rights of the data subject
In your capacity as data subject, you have the rights set out in Art. 7 of the Privacy Code and Art. 15 of the GDPR, specifically the rights to:
to obtain confirmation as to whether or not personal data concerning you exists, even if not yet recorded, and to receive such data in an intelligible form;
to obtain information: a) about the origin of personal data; b) about the purposes and methods of processing; c) about the logic applied in case of processing carried out with the aid of electronic tools; d) about the identification details of the data controller, the processors, and the designated representative pursuant to Art. 5, paragraph 2 of the Privacy Code and Art. 3, paragraph 1, GDPR; e) about the subjects or categories of subjects to whom personal data may be communicated or who may become aware of it as designated representatives in the territory of the State, as processors or persons in charge;
to obtain: a) the updating, rectification or, when interested, the integration of the data; b) the deletion, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disclosed, except in the case where this fulfillment proves impossible or involves the use of means manifestly disproportionate to the right protected;
to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning you, even if relevant to the purpose of collection; b) to the processing of personal data concerning you for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication, by means of automated calling systems without the intervention of an operator by email and/or by traditional marketing methods by telephone and/or paper mail. Please note that the right of the data subject to object, set out in the previous point b), for direct marketing purposes by automated means also extends to traditional methods and that, in any case, the data subject retains the possibility to exercise the right to object even only in part. Therefore, the data subject may decide to receive only communications by traditional methods or only automated communications or neither type of communication.
Where applicable, you also have the rights referred to in Articles 16–21, GDPR (Right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the Supervisory Authority.
12. Methods of exercising rights
You have the right to request from the Data Controller access to your Data, their rectification or deletion, the integration of incomplete Data, the restriction of processing; to receive the Data in a structured, commonly used and machine-readable format; to withdraw any consent given regarding the processing of your sensitive data at any time and to object, in whole or in part, to the use of the Data; to lodge a complaint with the Authority, as well as to exercise the other rights recognized to you by the applicable regulations.

13. Minors
Where the subject providing the data is under 16 years of age, such processing is lawful only if and to the extent that such consent is given or authorized by the holder of parental responsibility for whom identifying data is obtained.
